3. Account Registration

4. Subscription Plans & Billing

4.1 Free Tier

Free accounts include basic features with the following limitations:

• 10 sparks per day
• 10 messages per day
• Ad-supported experience

4.2 Premium Plans

We offer the following subscription plans:

• Monthly Plan: $19.99/month, billed monthly
• Quarterly Plan: $49.99/quarter, billed every 3 months
• Annual Plan: $99.99/year, billed yearly
• Single Boost: $4.99 per boost (one-time purchase)

4.3 Payment Processing

All payments are processed securely through CCBill, our third-party payment processor. By subscribing to a premium plan, you authorize us to charge your payment method on a recurring basis according to your chosen subscription term.

4.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your subscription plan.

4.5 Price Changes

We reserve the right to modify our pricing. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will notify you at least 30 days before any price increase takes effect.

5. Cancellation & Refunds

5.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting customer support at support@feelsparked.com. Cancellation will take effect at the end of your current billing period, and you will retain access to premium features until that date.

5.2 Refund Policy

We offer refunds under the following conditions:

• 7-Day Money-Back Guarantee: First-time subscribers may request a full refund within 7 days of their initial purchase
• Service Issues: If you experience technical problems that prevent you from using the Service, contact us within 7 days for a potential refund
• Unauthorized Charges: If you believe you were charged in error, contact us immediately

Refunds are not available for:

• Partial billing periods (prorated refunds are not offered)
• Canceled subscriptions after the current billing period has ended
• Single boost purchases (non-refundable once activated)
• Account suspensions or terminations due to Terms violations

5.3 Requesting a Refund

To request a refund, email support@feelsparked.com with your account email, order number, and reason for the refund request. Refunds are processed within 5-10 business days.

6. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Post false, misleading, or fraudulent content
• Upload content containing nudity, sexual content, or violence
• Spam or solicit other users for commercial purposes
• Scrape, data mine, or use automated tools to access the Service
• Circumvent security features or technical limitations
• Share your account credentials with others
• Use the Service if you are under 18 years of age

7. Content Guidelines

All user-generated content (photos, videos, messages, profile information) must comply with our community standards. Prohibited content includes:

• Nudity or sexually explicit material
• Hate speech, discrimination, or harassment
• Violence or threats
• Illegal activities or controlled substances
• Spam or commercial solicitation
• Copyrighted material you don't have rights to use

8. Privacy & Data Security

9. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Receive multiple user reports for misconduct
• Are under 18 years of age
• Fail to pay subscription fees

You may also terminate your account at any time by contacting support@feelsparked.com or deleting your account through account settings.

10. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, software, and design) are owned by FeelSparked and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you upload but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to provide the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free from viruses or harmful components
• You will meet compatible matches or find romantic relationships
• Other users' profiles are accurate or truthful

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEELSPARKED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Conduct or content of other users
• Unauthorized access to your account or data
• Any bugs, viruses, or technical issues

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

13. Indemnification

You agree to indemnify, defend, and hold harmless FeelSparked, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another user
• Content you upload or share on the Service

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. You waive your right to a jury trial and to participate in class actions.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
